Definitions

1.1 “Product”, “Products”, “Services” includes any type of goods or services offered through this website.
1.2 “Vendor”, “we” or “us” means www.becreative.com website, owned and operated by Elena’s Felting And Supplies.

General
2.1 These Terms and Conditions and Privacy Policy apply to any purchase of products or services from the Vendor. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
2.2 These Terms and Conditions and Privacy Policy may be amended periodically and you will be deemed to have accepted any amendments if you use the website after those amendments have been posted.
2.3 You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service (including Products descriptions and any graphic materials from our website), use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
2.4 You may not use our Products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Contract and price
3.1 All prices are in US Dollars.
3.2 Description of products and prices may be subject to change or correction at any time without notice. Although we seek to ensure information is correct, we make no representation or warranty as to information being accurate or complete. If we discover an error, we will try to notify you as soon as possible and allow you to cancel your order and obtain a refund if desired.
3.3 By submitting an order you warrant that:
- You are capable of entering into a legally binding contract with the Vendor,
- You are authorized and able to make payment via the method you have chosen,
- The shipping information you have provided is correct.
3.4 A contract for purchase is only formed once we have accepted a payment via PayPal or Credit Card.

Payment method
4.1 Payment can be made with valid credit cards (Visa, MasterCard, AMEX, Discover Global Network cards, JCB) via Square Processing System or through PayPal.

Delivery
5.1 Delivery time will vary depending on Canada Post or Chit Chats service (please see our Shipping Policy for more information). The Vendor is not liable for any loss arising from delays in delivery or failure to deliver (although you may request a refund if you do not receive products properly ordered: see section 6 below).

Returns & exchanges
6.1 Our policy lasts 15 days. If 15 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.
6.2 Conditions of return or exchange: Shipping costs are non-refundable; buyers are responsible for return shipping costs. If the item is not returned in its original condition, the buyer is responsible for any loss in value.
6.3 If you are shipping an item(s) over $50, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item(s).
6.4 Damaged products: If you receive your item damaged in transit please contact us immediately so that we may resolve the problem. Please be sure to check your package upon delivery - as we cannot accept claims after 2 days of receipt. A picture of the damage is required prior to any refunds (shipping costs are not refunded).

Warranties and Liabilities
7.1 The Vendor excludes any condition or warranty, unless it is expressly set out in these Terms and Conditions or is by law incapable of exclusion, restriction or modification.
7.2 The Vendor will under no circumstances be liable for any indirect, incidental or consequential loss or damage arising in relation to any transaction entered into, or any products or services purchased, through this website.

Privacy
8.1 The Vendor respects your privacy, as well as the confidentiality and the security of personal information provided by you. All information supplied by you is used by Elena’s Felting And Supplies solely for communication or promotion purposes.
8.2 When signing up for a newsletter from www.becreative.com, your email address is kept confidential and is used only for the purpose of sending newsletters, updates or special promotions.
8.3 When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection. An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.
8.4 If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
8.5 If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year. If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser. When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed. If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.
8.6 If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
8.7 If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
8.8 Visitor comments may be checked through an automated spam detection service.
8.9 We may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, we may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction.

Data Retention
9.1 We retain your personal information only for as long as necessary to provide you with our services and as described in our Privacy section. However, we may also be required to retain this information to comply with our legal and regulatory obligations, to resolve disputes, and to enforce our agreements.

Data Security
10.1 All the orders placed through this site are processed via PayPal and Square Payment Systems. Both PayPal and Square use SSL technology to keep your information safe. In addition, when you send a payment using PayPal or Square, we do not receive any sensitive financial information, we only receive your shipping address and use it in order to ship the purchased product.

Law
11.1 These Terms and Conditions are governed by the laws of the Province of Ontario, Canada. The parties irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.
